One licence, different rules per municipality

An operating licence is mandatory for any publicly accessible establishment, from a brasserie to a convenience store or snack bar. The municipality carries out a background check on the operator, based on an extract from the criminal record. You must also comply with other requirements, such as your FAVV registration and fire safety standards. The exact conditions and procedure vary from municipality to municipality.

Taking over means starting fresh

An operating licence is tied to the person and the building. Taking over an existing business, whether through the purchase of assets or shares? You still need to apply for a new licence yourself. The previous operator's licence does not automatically transfer to you. You can only open once you have the new licence in hand.


Example: Yusuf wants to open a chip shop in the heart of Antwerp, in a premises where there was already a chip shop. He assumes the previous owner's operating licence simply transfers with the lease agreement. Just before the planned opening, he learns that he must apply for a new licence, including a background check by the police.
